REGULAMIN PROGRAMU 

„REKRUTOMANIA Z RECREWTEREM”


§ 1

Postanowienia ogólne

  1. Niniejszy Regulamin Programu „Rekrutomania z Recrewterem” (dalej „Regulamin”) określa zasady i warunki uczestnictwa w programie „Rekrutomania z Recrewterem” (dalej „Program”), w ramach którego osoby polecające osoby z branży IT otrzymują świadczenie pieniężne po spełnieniu warunków określonych w Regulaminie (dalej „Nagroda”).
  2. Organizatorem Programu jest spółka Recrewter Sp. z o.o. z siedzibą we Wrocławiu, pl. Wolności 7, 50-071 Wrocław, zarejestrowana pod numerem KRS 0000713014 w Sądzie Rejonowym dla Wrocławia Fabrycznej we Wrocławiu, VI Wydział Gospodarczy Krajowego Rejestru Sądowego, NIP 8943122778, o kapitale zakładowym 50.000,00 zł (dalej „Recrewter”).
  3. Uczestnictwo w Programie jest dobrowolne.
  4. Program nie jest grą losową, zakładem wzajemnym, grą w karty, ani grą na automatach, których wynik zależy od przypadku w rozumieniu art. 2 ustawy o grach hazardowych.


§2

Uczestnicy Programu

  1. W Programie może wziąć udział każda osoba fizyczna, mająca miejsce zamieszkania na terenie Rzeczypospolitej Polskiej, posiadająca pełną zdolność do czynności prawnych (dalej „Polecający”), która poleci Recrewter kandydata z branży IT (dalej „Kandydat”).
  2. W Programie nie mogą brać udziału obecni i byli pracownicy lub współpracownicy Recrewter oraz członkowie ich rodzin. Przez członków rodzin, o których mowa w niniejszym ustępie, rozumie się małżonków, wstępnych, zstępnych, rodzeństwo, osoby pozostające w stosunku przysposobienia, konkubentów.
  3. Polecający nie może dokonać zgłoszenia Kandydata bez jego uprzedniej zgody. Ponadto Polecający zobowiązany jest do przekazania Kandydatowi treści niniejszego Regulaminu.
  4. Polecający nie może wskazać samego siebie jako Kandydata.
  5. Kandydatem może być wyłącznie osoba fizyczna posiadająca pełną zdolność do czynności prawnych, która nie była poprzednio zaangażowana w jakikolwiek proces rekrutacyjny prowadzony przez Recrewter, niezależnie od wyniku rekrutacji, w tym osoba której dane znajdują się już w bazie Recrewter oraz która zapoznała się z treścią Regulaminu.
  6. Osoby niespełniające warunków określonych w Regulaminie oraz osoby podające nieprawdziwe dane zostaną wykluczone z udziału w Programie i nie nabędą prawa do wypłaty Nagrody.


§3

Zasady uczestnictwa w Programie

  1. Polecenie Kandydatów następuje za pośrednictwem poczty elektronicznej e-mail – zgłoszenia są wysyłane przez Polecającego na adres e-mail: kontakt@recrewter.pl.
  2. Zgłoszenie musi zawierać:
  1. dane kontaktowe Polecającego (imię nazwisko, adres e-mail),
  2. oświadczenie Polecającego o wyrażeniu zgody na przetwarzanie jego danych osobowych i akceptacji Regulaminu:

„Wyrażam zgodę  na przetwarzanie moich danych osobowych przez Recrewter Sp. z o.o. z siedzibą we Wrocławiu w celu udziału w Programie. 

Oświadczam, że zapoznałem się i akceptuję Regulamin Programu „Rekrutomania z Recrewterem”,

  1. dane kontaktowe polecanego Kandydata (imię nazwisko, adres e-mail, numer telefonu) oraz CV polecanego Kandydata,      
  2. oświadczenie Kandydata o wyrażeniu zgody na przetwarzanie jego danych osobowych (skan, e-mail):

„Wyrażam zgodę na przetwarzanie przez Recrewter Sp. z o.o. z siedzibą we Wrocławiu moich danych osobowych zawartych w zgłoszeniu oraz w CV, w celu realizacji Programu „Rekrutomania z Recrewterem” oraz w celu udziału w procesach rekrutacyjnych, w tym przyszłych procesach rekrutacyjnych, organizowanych przez Recrewter. 

Oświadczam, że zapoznałem się z postanowieniami dotyczącymi zasad przetwarzania danych osobowych zawartymi w Regulaminie Programu „Rekrutomania z Recrewterem”. 

  1. Jeden Polecający może polecić dowolną ilość osób.
  2. Danego Kandydata może polecić wyłącznie jeden Polecający. W przypadku większej ilości zgłoszeń, decyduje kolejność zgłoszeń (data i godzina wysłania e-maila przez Polecającego).
  3. Nie ma wymogu wskazywania przez Polecającego konkretnego stanowiska, na które poleca danego Kandydata.


§4 

Nagrody

  1. Polecający nabywa prawo do Nagrody w przypadku gdy polecony przez niego Kandydat przystąpi do procesu rekrutacyjnego prowadzonego przez Recrewter i w jego rezultacie zostanie zatrudniony przez klienta Recrewter (na podstawie umowy o pracę lub umowy cywilnoprawnej) oraz przepracuje minimum 3 miesiące.
  2. Wysokość Nagrody uzależniona jest od rodzaju stanowiska, na którym zatrudniony zostanie Kandydat przez klienta Recrewter:
  1. 1500 PLN (słownie: tysiąc pięćset złotych) brutto za zatrudnienie Kandydata na stanowisku na poziomie Junior, tj. z doświadczeniem 0-2 lata,
  2. 3000 PLN (słownie: trzy tysiące złotych) brutto za zatrudnienie Kandydata na stanowisku na poziomie Mid, tj. z doświadczeniem od 2 do 4 lat,
  3. 5000 PLN (słownie: pięć tysięcy złotych) brutto za zatrudnienie Kandydata na stanowisku na poziomie Senior, tj. z doświadczeniem powyżej 4 lat.  
  1. Recrewter poinformuje Polecającego w drodze e-mail o przyznaniu Nagrody w terminie 14 dni od dnia spełniania przesłanek, o których mowa w ust 1 powyżej.
  2. Wypłata Nagrody Polecającemu wymaga przekazania przez Polecającego do Recrewter danych niezbędnych do wypłaty Nagrody, w tym w szczególności w zakresie danych wymaganych do sporządzenia przez Recrewter formularza PIT-8C.
  3. Wypłata Nagrody realizowana jest przez Recrewter przelewem na rachunek bankowy wskazany przez Polecającego.
  4. Nagroda stanowi dla Polecającego przychód na podstawie ustawy o podatku dochodowym od osób fizycznych. Recrewter sporządzi i przekaże Polecającemu informację podatkową zgodnie z obowiązującymi przepisami. 


§5

Ochrona danych osobowych Polecających

  1. Administratorem danych osobowych Polecających jest Recrewter Sp. z o.o., pl. Wolności 7, 50-071 Wrocław.
  2. Dane osobowe Polecających będą przetwarzane:
  1. w celu udziału w Programie, na podstawie zgody (art. 6 ust. 1. lit. a) RODO),
  2. w celach związanych z prowadzoną działalnością gospodarczą oraz w celach kontaktowych oraz w celu rozpatrywania reklamacji oraz ochrony przed roszczeniami i w celu dochodzenia własnych roszczeń (art. 6 ust. 1 lit. f) RODO - prawnie uzasadniony interes Administratora),
  3. w celu udokumentowania udziału w Programie i jego rozliczenia – w przypadku wypłaty Nagrody na rzecz Polecającego (art. 6 ust. 1 lit. c) RODO).
  1. Dane osobowe Polecających mogą zostać udostępnione podmiotom upoważnionym na podstawie przepisów prawa, jak również zewnętrznym dostawcom usług (tj. podmiotom, którym Recrewter powierzył przetwarzanie danych osobowych, np. podmiotom świadczącym usługi IT, udostępnienia serwerów, prawne, doradcze w zakresie rekrutacji).
  2. Dane osobowe Polecających nie będą przekazywane do państwa trzeciego lub organizacji międzynarodowej.
  3. Dane osobowe Polecających będą przechowywane nie dłużej niż potrzebne do realizacji celu, w którym zostały zgromadzone albo do czasu cofnięcia zgody lub wniesienia sprzeciwu.
  4. Polecający mają prawo do żądania od Recrewter dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania lub prawo do wniesienia sprzeciwu wobec przetwarzania, a także prawo do przenoszenia danych. Powyższe uprawnienia mogą być jednak ograniczone przez szczególny przepis prawa.
  5. Polecający mogą cofnąć zgodę na przetwarzanie ich danych osobowych w w/w zakresie w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem. Informacje o wycofaniu zgody należy przesłać na adres e-mail: kontakt@recrewter.pl.
  6. Polecający mają prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych, jeżeli stwierdzą, iż przetwarzanie ich danych osobowych narusza przepisy o ochronie danych osobowych.
  7. Podanie danych osobowych jest dobrowolne, jednakże brak zgody uniemożliwi udział w Programie.


§6

Ochrona danych osobowych Kandydatów

  1. Administratorem danych osobowych Kandydatów jest Recrewter Sp. z o.o., pl. Wolności 7, 50-071 Wrocław.
  2. Dane osobowe Kandydatów będą przetwarzane:
  1. w celu realizacji Programu oraz w celach prowadzenia procesów rekrutacyjnych, w tym przyszłych procesów rekrutacyjnych, na podstawie zgody (art. 6 ust. 1. lit. a) RODO),
  2. w celach związanych z prowadzoną działalnością gospodarczą oraz w celach kontaktowych oraz w celu ochrony przed roszczeniami i w celu dochodzenia własnych roszczeń (art. 6 ust. 1 lit. f) RODO - prawnie uzasadniony interes Administratora),
  3. w ramach profilowania, w celu skierowania do kandydata odpowiedniej i najbardziej optymalnej oferty pracy (art. 6 ust. 1 lit. f) RODO - prawnie uzasadniony interes Administratora: przyspieszenie i usprawnienie procesu rekrutacji).
  1. Dane osobowe Kandydatów mogą zostać udostępnione potencjalnym pracodawcom oraz podmiotom upoważnionym na podstawie przepisów prawa, jak również zewnętrznym dostawcom usług (tj. podmiotom, którym Recrewter powierzył przetwarzanie danych osobowych, np. podmiotom świadczącym usługi IT, udostępnienia serwerów, prawne, doradcze w zakresie rekrutacji).
  2. W przypadku prowadzenia rekrutacji na rzecz potencjalnych pracodawców mających siedzibę spoza Europejskiego Obszaru Gospodarczego (EOG), dane osobowe Kandydatów będą mogły zostać przekazane do państwa trzeciego, w którym siedzibę ma dany potencjalny pracodawca, w przypadku stwierdzenia przez Komisję Europejską odpowiedniego stopnia ochrony w w/w państwie trzecim lub zawarcia umowy gwarantującej odpowiedni poziom ochrony, m.in. na podstawie standardowych klauzul umownych.
  3. Dane osobowe Kandydatów będą przechowywane nie dłużej niż potrzebne do realizacji celu, w którym zostały zgromadzone albo do czasu cofnięcia zgody lub wniesienia sprzeciwu.
  4. Kandydaci mają prawo do żądania od Recrewter dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania lub prawo do wniesienia sprzeciwu wobec przetwarzania, a także prawo do przenoszenia danych. Powyższe uprawnienia mogą być jednak ograniczone przez szczególny przepis prawa.
  5. Kandydaci mogą cofnąć zgodę na przetwarzanie ich danych osobowych w w/w zakresie w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem. Informacje o wycofaniu zgody należy przesłać na adres e-mail: kontakt@recrewter.pl.
  6. Kandydaci mają prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych, jeżeli stwierdzą, iż przetwarzanie ich danych osobowych narusza przepisy o ochronie danych osobowych.
  7. Podanie danych osobowych jest dobrowolne, brak zgody uniemożliwi udział w Programie oraz w procesie rekrutacyjnych.
  8. Dane osobowe Kandydatów zostały pozyskane przez Recrewter od Polecającego danego Kandydata.
  9. Dane osobowe Kandydatów mogą podlegać profilowaniu, poprzez automatyczne dopasowanie profilu Kandydata pod oferty pracy.


§7

Reklamacje 

  1. Uczestnik Programu może składać reklamacje dotyczące Programu w formie pisemnej, na adres Recrewter lub za pośrednictwem wiadomości e-mail wysłanej na adres: kontakt@recrewter.pl.
  2. Reklamacje powinny wskazywać dane wnoszącego reklamację (imię, nazwisko, adres e-mail lub adres korespondencyjny) oraz wskazanie jej przyczyn.
  3. Reklamacje będą rozpatrywane w ciągu 14 dni od dnia ich otrzymania przez Recrewter.


§8

Postanowienia końcowe

  1. Każdy Polecający jest zobowiązany zapoznać się z treścią niniejszego Regulaminu. Uczestnictwo w Programie oznacza akceptację Regulaminu.
  2. Program obowiązuje przez czas nieokreślony. Recrewter może zakończyć Program w dowodnym momencie, co zostanie ogłoszone na stronie internetowej Recrewter. W przypadku zakończenia Programu, wszystkie zgłoszenia dokonane przed ogłoszeniem o zakończeniu zostaną rozpatrzone w Programie. Zgłoszenia przesłane po ogłoszonej dacie zakończenia Programu nie będą rozpatrywane.
  3. Recrewter może dokonać zmiany Regulaminu i warunków Programu w okresie trwania Programu, jeżeli jest to uzasadnione celem Programu i nie wpłynie na pogorszenie warunków uczestnictwa, z tym że zmiany te nie mogą naruszać praw już nabytych przez uczestników Programu. Wszyscy uczestnicy Programu zostaną powiadomieni o zmianie Regulaminu poprzez ogłoszenie na stronie internetowej Recrewter oraz wiadomość e-mail na adresy wskazane w zgłoszeniu. 
  4. Regulamin wchodzi w życie z dniem jego ogłoszenia na stronie internetowej Recrewter.

REGULATIONS OF THE "RECRUITOMANIA WITH RECREWTER" PROGRAM


§ 1

General provisions

  1. These Regulations of the "Recruitomania with Recrewter" Program (hereinafter the "Regulations") stipulate the terms and conditions of participation in the "Recruitomania with Recrewter" program (hereinafter the "Program"), in which persons recommending persons from the IT industry receive a cash benefit after fulfilling the conditions set forth in the Regulations (hereinafter the "Award"). 
  2. The organizer of the Program is Recrewter Sp. z o.o. with its registered office in Wroclaw, pl. Wolności 7, 50-071 Wroclaw, registered under KRS number 0000713014 in the District Court for Wroclaw Fabryczna in Wroclaw, VI Commercial Department of the National Court Register, NIP 8943122778, with a share capital of 50,000.00 zł (hereinafter "Recrewter"). 
  3. The participation in the Program is voluntary.
  4. The Program is not a game of chance, a mutual bet, a game of cards or a game on slot machines, the result of which depends on chance within the meaning of Art. 2 of the Gambling Act.


§2

Participants of the Program

  1. Any natural person with the place of residence in the Republic of Poland and with a full legal capacity (hereinafter the "Recommending Person"), and who recommends a candidate from the IT industry to Recrewter (hereinafter the "Candidate") can participate in the Program.
  2. The Recrewter’s current and former employees and associates and their family members cannot participate in the Program. The family members referred to in this point shall be understood as spouses, ascendants, descendants, siblings, adopted persons, cohabitants.
  3. The Recommending Person shall not make an application of the Candidate without his/her prior consent. In addition, the Recommending Person is obliged to provide the Candidate with the content of these Regulations. 
  4. The Recommending Person may not indicate himself/herself as a Candidate.
  5. The Candidate may only be a natural person with a full legal capacity, who has not previously been involved in any recruitment process conducted by Recrewter, regardless of the outcome of the recruitment, including the person whose data is already in the Recrewter database and who is familiar with the content of the Regulations.
  6. The persons who do not fulfill the terms and conditions set forth in the Regulations or who provide false information shall be excluded from participation in the Program and shall not be entitled to the payment of the Award.


§3

Rules of participation in the Program

  1. The recommendation of the Candidates is made via e-mail – the applications are sent by the Recommending Person to the e-mail address: kontakt@recrewter.pl.
  2. The application must include:
  1. Recommending Person’s contact details (name, e-mail address),
  2. Recommending Person’s statement of consent to the processing of his/her personal data and acceptance of the Regulations:

"I agree to the processing of my personal data by Recrewter Sp. z o.o. with its registered office in Wroclaw for the purpose of participation in the Program. 

I declare that I have read and accept the Regulations of the "Recruitomania with Recrewter" Program”,

  1. recommended Candidate’s contact details (name, e-mail address, phone number) and the recommended Candidate’s CV, 
  2. Candidate's statement of consent to the processing of his/her personal data (scan, e-mail):

"I agree to the processing of my personal data included in the application and CV by Recrewter Sp. z o.o. with its registered office in Wroclaw for the purposes of the "Recruitomania with Recrewter" Program and to participate in the recruitment processes, including future recruitment processes, conducted by Recrewter. 

I declare that I have read and accept the Regulations of the "Recruitomania with Recrewter" Program”,

  1. One Recommending Person can recommend any number of people.
  2. Only one Recommending Person can recommend a given Candidate. In case of multiple referrals, the order of referrals shall be decisive (date and time of sending e-mail by the Recommending Person).
  3. It is not necessary to indicate the specific position to which the Recommending Person recommends a given Candidate.


§4

Awards

  1. The Recommending Person acquires the right to the Award if the Candidate recommended by him/her enters the recruitment process conducted by Recrewter and as a result is employed by Recrewter’s client (on the basis of the employment contract or civil contract) and works for a minimum of 3 months. 
  2. The amount of the Award depends on the type of position at which the candidate shall be employed by Recrewter’s client:
  1. 1500 PLN (in words: one thousand five hundred zlotys) gross for employing a Candidate on a Junior level position, i.e. with 0-2 years of experience,
  2. 3000 PLN (in words: three thousand zlotys) gross for employing a Candidate on a Mid level, i.e. with experience from 2 to 4 years,
  3. 5000 PLN (in words: five thousand zlotys) gross for employing a Candidate on a Senior level, i.e. with experience above 4 years. 
  1. Recrewter shall inform the Recommending Person via e-mail about granting the Award within 14 days from the date of fulfilling the conditions referred to in point 1 above.
  2. The payment of the Award to the Recommending Person shall be subject to the provision by the Recommending Person of the data necessary for the payment of the Award, in particular the data required for Recrewter to draw up the PIT-8C form.
  3. The payment of the Award shall be made by Recrewter by a wire transfer to the bank account indicated by the Recommending Person.
  4. The Award is the income for the Recommending Person pursuant to the Personal Income Tax Act. Recrewter shall draw up and provide the Recommending Person with tax information in accordance with applicable regulations.


§5

Protection of Recommending Persons’ personal data 

  1. Recrewter Sp. z o.o., pl. Wolności 7, 50-071 Wrocław is the controller of Recommending Persons’ personal data.
  2. The Recommending Persons’ personal data shall be processed:
  1. for the purpose of participation in the Program, on the basis of consent (Article 6 (1) (a) GDPR),
  2. for the purposes related to the conducted business and for contact purposes as well as for the purpose of handling complaints and protection against claims and for the purpose of pursuing one's own claims (Article 6 (1) (f) GDPR – controller’s legitimate interest),
  3. for the purpose of documenting the participation in the Program and its settlement - in case of payment of the Award to the Recommending Person (Article 6 (1) (c) GDPR).
  1. The Recommending Party’s personal may be disclosed to entities authorized by law, as well as to the external service providers (i.e. entities to whom Recrewter entrusted the processing of personal data, e.g. entities providing IT services, server access, legal services, recruitment consulting).
  2. The Recommending Persons’ personal data shall not be transferred to a third country or international organisation.
  3. The Recommending Persons’ personal data shall be stored for no longer than necessary for the purpose for which it was collected or until the withdrawal of consent or objection.
  4. The Recommending Persons have the right to require Recrewter to access, rectify, erase or restrict processing of their personal data or to object to processing, as well as the right to data portability. However, the above rights may be limited by a specific legal provision.
  5. The Recommending Persons may withdraw their consent to the processing of their personal data in the abovementioned scope at any time without affecting the lawfulness of processing based on consent before its withdrawal. The information about the withdrawal of the consent should be sent to the e-mail address: kontakt@recrewter.pl.
  6. The Recommending Persons have the right to lodge a complaint to the President of the Office for Personal Data Protection, if they find that the processing of their personal data violates the provisions on the personal data protection.
  7. Providing personal data is voluntary, however, the lack of consent shall prevent from the participation in the Program.


§6

Protection of Candidates’ personal data 

  1. Recrewter Sp. z o.o., pl. Wolności 7, 50-071 Wrocław is the controller of Candidates’ personal data.
  2. The Candidates' personal data shall be processed:
  1. for the purpose of conducting the Program recruitment processes, including future recruitment processes, on the basis of consent (Art. 6 (1) (a) GDPR),
  2. for the purposes related to the conducted business and for contact purposes as well as for the purpose of handling complaints and protection against claims and for the purpose of pursuing one's own claims (Article 6 (1) (f) GDPR – controller’s legitimate interest),
  3. for profiling, in order to address the appropriate and optimal job offer to a candidate (Article 6 (1) (f) GDPR) – Controller’s legitimate interest - acceleration and improvement of effectiveness of the recruitment process).
  1. Candidates' personal data may be disclosed to potential employers and entities authorized by law, as well as to the external service providers (i.e. entities to which Recrewter entrusted the processing of personal data, e.g. entities providing IT, server access, legal, recruitment consulting services).
  2. In case of recruitment to potential employers with registered office outside the European Economic Area (EEA), my personal data may be transferred to a third country where a potential employer has its registered office, if the European Commission decides that an adequate level of protection is ensured in a third country or in case of conclusion of an agreement guaranteeing an adequate level of protection, inter alia based on standard contractual clauses.
  1. The Candidates’ personal data shall be stored for no longer than necessary for the purpose for which it was collected or until the withdrawal of consent or objection.
  1. The Candidates have the right to require Recrewter to access, rectify, erase or restrict processing of their personal data or to object to processing, as well as the right to data portability. However, the above rights may be limited by a specific legal provision.
  2. The Candidates may withdraw their consent to the processing of their personal data in the abovementioned scope at any time without affecting the lawfulness of processing based on consent before its withdrawal. The information about the withdrawal of the consent should be sent to the e-mail address: kontakt@recrewter.pl.
  1. The Candidates have the right to lodge a complaint to the President of the Office for Personal Data Protection, if they find that the processing of their personal data violates the provisions on the personal data protection.
  2. Providing personal data is voluntary, the lack of consent shall prevent from the participation in the Program and in the recruitment process.
  3. The Candidates' personal data has been obtained by Recrewter from the Recommending Person of a given candidate.
  4. The Candidates' personal data may be subject to profiling through automatic matching of Candidate’s profile with job offers.


§7

Complaints

  1. The participant of the Program may submit complaints regarding the Program in writing to the Recrewter's address or via email sent to: kontakt@recrewter.pl. 
  2. The complaints should indicate the data of the complainant (name, surname, e-mail address or mailing address) and the reasons for the complaint. 
  3. The complaints shall be settled within 14 days of their receipt by Recrewter.




§8

Final provisions

  1. Each Recommending Person is obliged to read the content of these Regulations. By participating in the Program, you accept the Regulations.
  2. The Program is valid for an unlimited period of time. Recrewter may terminate the Program at any time, which shall be announced on Recrewter's website. In case of termination of the Program, all applications made before the announcement of termination shall be taken into account in the Program. The applications submitted after the announced end date of the Program shall not be taken into account.
  3. Recrewter may amend the Regulations and the terms and conditions of the Program during the term of the Program, if it is justified by the purpose of the Program and shall not deteriorate the participation conditions. However, these changes may not infringe the rights already acquired by the participants of the Program. All participants of the Program shall be informed about the amendments in the Regulations by an announcement on Recrewter's website and an e-mail to the addresses indicated in the application. 
  4. The Regulations come into force on the day of their announcement on Recrewter's website.

REGULATIONS OF THE "RECRUITOMANIA WITH RECREWTER" PROGRAM


§ 1

General provisions

  1. These Regulations of the "Recruitomania with Recrewter" Program (hereinafter the "Regulations") stipulate the terms and conditions of participation in the "Recruitomania with Recrewter" program (hereinafter the "Program"), in which persons recommending persons from the IT industry receive a cash benefit after fulfilling the conditions set forth in the Regulations (hereinafter the "Award"). 
  2. The organizer of the Program is Recrewter Sp. z o.o. with its registered office in Wroclaw, pl. Wolności 7, 50-071 Wroclaw, registered under KRS number 0000713014 in the District Court for Wroclaw Fabryczna in Wroclaw, VI Commercial Department of the National Court Register, NIP 8943122778, with a share capital of 50,000.00 zł (hereinafter "Recrewter"). 
  3. The participation in the Program is voluntary.
  4. The Program is not a game of chance, a mutual bet, a game of cards or a game on slot machines, the result of which depends on chance within the meaning of Art. 2 of the Gambling Act.


§2

Participants of the Program

  1. Any natural person with the place of residence in the Republic of Poland and with a full legal capacity (hereinafter the "Recommending Person"), and who recommends a candidate from the IT industry to Recrewter (hereinafter the "Candidate") can participate in the Program.
  2. The Recrewter’s current and former employees and associates and their family members cannot participate in the Program. The family members referred to in this point shall be understood as spouses, ascendants, descendants, siblings, adopted persons, cohabitants.
  3. The Recommending Person shall not make an application of the Candidate without his/her prior consent. In addition, the Recommending Person is obliged to provide the Candidate with the content of these Regulations. 
  4. The Recommending Person may not indicate himself/herself as a Candidate.
  5. The Candidate may only be a natural person with a full legal capacity, who has not previously been involved in any recruitment process conducted by Recrewter, regardless of the outcome of the recruitment, including the person whose data is already in the Recrewter database and who is familiar with the content of the Regulations.
  6. The persons who do not fulfill the terms and conditions set forth in the Regulations or who provide false information shall be excluded from participation in the Program and shall not be entitled to the payment of the Award.


§3

Rules of participation in the Program

  1. The recommendation of the Candidates is made via e-mail – the applications are sent by the Recommending Person to the e-mail address: kontakt@recrewter.pl.
  2. The application must include:
  1. Recommending Person’s contact details (name, e-mail address),
  2. Recommending Person’s statement of consent to the processing of his/her personal data and acceptance of the Regulations:

"I agree to the processing of my personal data by Recrewter Sp. z o.o. with its registered office in Wroclaw for the purpose of participation in the Program. 

I declare that I have read and accept the Regulations of the "Recruitomania with Recrewter" Program”,

  1. recommended Candidate’s contact details (name, e-mail address, phone number) and the recommended Candidate’s CV, 
  2. Candidate's statement of consent to the processing of his/her personal data (scan, e-mail):

"I agree to the processing of my personal data included in the application and CV by Recrewter Sp. z o.o. with its registered office in Wroclaw for the purposes of the "Recruitomania with Recrewter" Program and to participate in the recruitment processes, including future recruitment processes, conducted by Recrewter. 

I declare that I have read and accept the Regulations of the "Recruitomania with Recrewter" Program”,

  1. One Recommending Person can recommend any number of people.
  2. Only one Recommending Person can recommend a given Candidate. In case of multiple referrals, the order of referrals shall be decisive (date and time of sending e-mail by the Recommending Person).
  3. It is not necessary to indicate the specific position to which the Recommending Person recommends a given Candidate.


§4

Awards

  1. The Recommending Person acquires the right to the Award if the Candidate recommended by him/her enters the recruitment process conducted by Recrewter and as a result is employed by Recrewter’s client (on the basis of the employment contract or civil contract) and works for a minimum of 3 months. 
  2. The amount of the Award depends on the type of position at which the candidate shall be employed by Recrewter’s client:
  1. 1500 PLN (in words: one thousand five hundred zlotys) gross for employing a Candidate on a Junior level position, i.e. with 0-2 years of experience,
  2. 3000 PLN (in words: three thousand zlotys) gross for employing a Candidate on a Mid level, i.e. with experience from 2 to 4 years,
  3. 5000 PLN (in words: five thousand zlotys) gross for employing a Candidate on a Senior level, i.e. with experience above 4 years. 
  1. Recrewter shall inform the Recommending Person via e-mail about granting the Award within 14 days from the date of fulfilling the conditions referred to in point 1 above.
  2. The payment of the Award to the Recommending Person shall be subject to the provision by the Recommending Person of the data necessary for the payment of the Award, in particular the data required for Recrewter to draw up the PIT-8C form.
  3. The payment of the Award shall be made by Recrewter by a wire transfer to the bank account indicated by the Recommending Person.
  4. The Award is the income for the Recommending Person pursuant to the Personal Income Tax Act. Recrewter shall draw up and provide the Recommending Person with tax information in accordance with applicable regulations.


§5

Protection of Recommending Persons’ personal data 

  1. Recrewter Sp. z o.o., pl. Wolności 7, 50-071 Wrocław is the controller of Recommending Persons’ personal data.
  2. The Recommending Persons’ personal data shall be processed:
  1. for the purpose of participation in the Program, on the basis of consent (Article 6 (1) (a) GDPR),
  2. for the purposes related to the conducted business and for contact purposes as well as for the purpose of handling complaints and protection against claims and for the purpose of pursuing one's own claims (Article 6 (1) (f) GDPR – controller’s legitimate interest),
  3. for the purpose of documenting the participation in the Program and its settlement - in case of payment of the Award to the Recommending Person (Article 6 (1) (c) GDPR).
  1. The Recommending Party’s personal may be disclosed to entities authorized by law, as well as to the external service providers (i.e. entities to whom Recrewter entrusted the processing of personal data, e.g. entities providing IT services, server access, legal services, recruitment consulting).
  2. The Recommending Persons’ personal data shall not be transferred to a third country or international organisation.
  3. The Recommending Persons’ personal data shall be stored for no longer than necessary for the purpose for which it was collected or until the withdrawal of consent or objection.
  4. The Recommending Persons have the right to require Recrewter to access, rectify, erase or restrict processing of their personal data or to object to processing, as well as the right to data portability. However, the above rights may be limited by a specific legal provision.
  5. The Recommending Persons may withdraw their consent to the processing of their personal data in the abovementioned scope at any time without affecting the lawfulness of processing based on consent before its withdrawal. The information about the withdrawal of the consent should be sent to the e-mail address: kontakt@recrewter.pl.
  6. The Recommending Persons have the right to lodge a complaint to the President of the Office for Personal Data Protection, if they find that the processing of their personal data violates the provisions on the personal data protection.
  7. Providing personal data is voluntary, however, the lack of consent shall prevent from the participation in the Program.


§6

Protection of Candidates’ personal data 

  1. Recrewter Sp. z o.o., pl. Wolności 7, 50-071 Wrocław is the controller of Candidates’ personal data.
  2. The Candidates' personal data shall be processed:
  1. for the purpose of conducting the Program recruitment processes, including future recruitment processes, on the basis of consent (Art. 6 (1) (a) GDPR),
  2. for the purposes related to the conducted business and for contact purposes as well as for the purpose of handling complaints and protection against claims and for the purpose of pursuing one's own claims (Article 6 (1) (f) GDPR – controller’s legitimate interest),
  3. for profiling, in order to address the appropriate and optimal job offer to a candidate (Article 6 (1) (f) GDPR) – Controller’s legitimate interest - acceleration and improvement of effectiveness of the recruitment process).
  1. Candidates' personal data may be disclosed to potential employers and entities authorized by law, as well as to the external service providers (i.e. entities to which Recrewter entrusted the processing of personal data, e.g. entities providing IT, server access, legal, recruitment consulting services).
  2. In case of recruitment to potential employers with registered office outside the European Economic Area (EEA), my personal data may be transferred to a third country where a potential employer has its registered office, if the European Commission decides that an adequate level of protection is ensured in a third country or in case of conclusion of an agreement guaranteeing an adequate level of protection, inter alia based on standard contractual clauses.
  1. The Candidates’ personal data shall be stored for no longer than necessary for the purpose for which it was collected or until the withdrawal of consent or objection.
  1. The Candidates have the right to require Recrewter to access, rectify, erase or restrict processing of their personal data or to object to processing, as well as the right to data portability. However, the above rights may be limited by a specific legal provision.
  2. The Candidates may withdraw their consent to the processing of their personal data in the abovementioned scope at any time without affecting the lawfulness of processing based on consent before its withdrawal. The information about the withdrawal of the consent should be sent to the e-mail address: kontakt@recrewter.pl.
  1. The Candidates have the right to lodge a complaint to the President of the Office for Personal Data Protection, if they find that the processing of their personal data violates the provisions on the personal data protection.
  2. Providing personal data is voluntary, the lack of consent shall prevent from the participation in the Program and in the recruitment process.
  3. The Candidates' personal data has been obtained by Recrewter from the Recommending Person of a given candidate.
  4. The Candidates' personal data may be subject to profiling through automatic matching of Candidate’s profile with job offers.


§7

Complaints

  1. The participant of the Program may submit complaints regarding the Program in writing to the Recrewter's address or via email sent to: kontakt@recrewter.pl. 
  2. The complaints should indicate the data of the complainant (name, surname, e-mail address or mailing address) and the reasons for the complaint. 
  3. The complaints shall be settled within 14 days of their receipt by Recrewter.




§8

Final provisions

  1. Each Recommending Person is obliged to read the content of these Regulations. By participating in the Program, you accept the Regulations.
  2. The Program is valid for an unlimited period of time. Recrewter may terminate the Program at any time, which shall be announced on Recrewter's website. In case of termination of the Program, all applications made before the announcement of termination shall be taken into account in the Program. The applications submitted after the announced end date of the Program shall not be taken into account.
  3. Recrewter may amend the Regulations and the terms and conditions of the Program during the term of the Program, if it is justified by the purpose of the Program and shall not deteriorate the participation conditions. However, these changes may not infringe the rights already acquired by the participants of the Program. All participants of the Program shall be informed about the amendments in the Regulations by an announcement on Recrewter's website and an e-mail to the addresses indicated in the application. 
  4. The Regulations come into force on the day of their announcement on Recrewter's website.
